If you do not agree to these policies, do not complete your booking. You hereby grant agency authority to any party who clicks on the “Continue” button or completes a booking with Bodywrx., or otherwise indicates acceptance to these terms of service on your behalf.

Arbitration Notice: 

By agreeing to these Terms, you agree that disputes between you and us or you and the medical groups or providers arising out of or related to these terms of service or the service will be resolved by binding, individual arbitration and you waive your rights to a jury trial and to participate in a class action lawsuit or class-wide arbitration, as further set forth herein.

If you have a medical emergency, seek in-person emergency care immediately or dial 911. the service is not appropriate for all medical conditions or concerns. These terms of service are subject to change as provided herein.

Bodywrx Inc. (“Bodywrx,” “the Site,”, “we” or “us”) owns and operates this website located at https://thebodywrx.com/, as well as the secure patient portal (the “Portal”). Bodywrx provides the Site and accompanying booking and membership services (the “Service”) and connects individuals to local healthcare providers in their area. Your access and use of the Site, the Portal, and the Service are governed by these Terms and Conditions (“Terms and Conditions”, “Terms”, or “Agreement”). Your access to and use of the Site, the Portal, and services is conditioned on your acceptance of and compliance with these Terms. By accessing or using the Site or services, you agree to be bound by these Terms.

Please read this Agreement carefully because it sets forth the important terms you will need to know about the Service. In this Agreement, the terms “you” and “yours” refer to the person using the Service, or in the case of a use of the Service by or on behalf of a minor, “you” and “yours” refer to and include (i) the parent or legal guardian who provides consent to the use of the Service by such minor or uses the Service on behalf of the minor, and (ii) the minor for whom consent is being provided or on whose behalf the Service is being utilized. Please see the “Limited Use and Availability” Section of this Agreement for more information regarding use of the Service by minors and applicable limitations on such use. Notwithstanding the foregoing, the Service is not intended for individuals under the age of thirteen (13) and individuals under the age of thirteen (13) are prohibited from using all or any part of the Service or entering into this Agreement, even if a parent or legal guardian would be willing to provide consent to use of the Service or this Agreement. Please contact us at info@thebodywrx.com if you are a parent or legal guardian of an individual under the age of eighteen (18) who you believe has used the Service without your consent.

Services: 

Bodywrx provides a range of health and wellness services, including but not limited to NAD+ therapy, ozone therapy, IV therapy, peptides, chiropractic care, LED light therapy, exosomes, stem cell therapy, facial aesthetics, Jan Marini skin care, bioidentical hormone replacement, lab draws, telehealth, post-operative VIP packages, and pulsed electromagnetic frequency. The availability of specific services is subject to change without notice.

Confidentiality: 

Bodywrx is committed to maintaining the confidentiality of all client information. We will not disclose any information without the client’s written consent, except as required by law.

Liability: 

Bodywrx is not liable for any damages arising from using our services, products, the Portal, or the Site. Clients assume full responsibility for their own health and wellness.

Disclaimer: 

The information provided on the Site and the Portal, and through our services and products, is for educational purposes only and is not intended to diagnose, treat, cure, or prevent any disease. Clients should consult with a licensed healthcare provider before making any changes to their health and wellness routines. Bodywrx is not responsible for any adverse effects resulting from the use of our services and products.

Changes: 

Bodywrx reserves the right to modify these Terms at any time. Changes will be posted on the Site and on the Portal, and your continued use of the Site and of the Portal, or services and products constitutes your acceptance of the modified Terms.

Governing Law: 

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Dispute Resolution: 

Any disputes arising from or related to these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

Payment: 

Payment for services is due at the time services are rendered unless otherwise agreed in writing. Payment for products is due at the time of purchase or, where applicable, upon review and approval of the order by BODYWRX.

BODYWRX accepts cash, checks, and major credit cards, as well as any additional payment methods displayed at the time of booking or purchase.

By providing a payment method, you represent that you are authorized to use that payment method and authorize BODYWRX to charge the payment method on file for all amounts due, including reservation deposits, consultation fees, treatment fees, products, travel fees, applicable taxes, late cancellation fees, no-show charges, minimum appointment commitments where applicable, outstanding balances, and any other charges authorized under these Terms or otherwise disclosed to you prior to being charged.

Any unpaid balance may be charged to the payment method on file following the completion of services. BODYWRX reserves the right to suspend or refuse future bookings or services until any outstanding balance has been paid in full.

Limited Use and Availability:

Our Service is currently only available to individuals who are located in states and countries in which we offer the Service, are at least eighteen (18) years of age or older, or at least the age of majority in their jurisdiction of residence, if higher than eighteen (18), and who have accepted this Agreement; provided, however, that individuals who are located in the states and countries in which we offer the Service and are between the ages of 13 and 18 may use the Service if a parent or legal guardian provides consent to such use in accordance with the requirements set forth in this Agreement and the Service. By visiting, accessing, registering with or using the Service, you are (a) representing and warranting to us that you are either (1) at least eighteen (18) years of age or older or at least the age of majority in your jurisdiction of residence, if higher than eighteen, or (2) at least thirteen (13) years of age and have obtained consent from your parent or legal guardian to use the Service, (b) if you are a parent or legal guardian providing consent for an individual minor who is under the age of eighteen (18) (or such higher age of majority under applicable state law), representing and warranting to us that you are the parent or legal guardian for such minor and have all legal power and authority to provide consent for the use of the Service by such minor, (c) representing and warranting to us that when you use the Service to consult with a Provider, you are located in the same state as the shipping address you provide in your account at the time that you conduct such consultation, (d) agreeing to comply with all applicable laws in visiting, accessing, registering with our using the Service, and (e) agreeing that you will only use the Service for lawful purposes. Our Service is subject to state and local regulations and may change from time to time due to changes in applicable regulatory requirements.

Certain products available through the Service are subject to additional age restrictions, and not all products or services are available to all ages.

In some cases, the Service may not be the most appropriate way for you to provide information to, communicate with or seek medical care and treatment from a healthcare provider. For example, certain medical conditions may require an in-person procedure or a healthcare provider other than your Provider, or your Provider may determine that your diagnosis and/or treatment requires an in-person office visit or are otherwise not appropriately addressed through use of the Service. In such a case, you may receive notification that you will be unable to use the Service for the particular issue you submitted with additional information regarding next steps.

Financial and Booking Policy

Reservation Deposits:

Mobile In-Person Services

A $99 reservation deposit is required to secure all mobile in-person appointments.

The reservation deposit is held as account credit and applied toward the final invoice for the appointment, which may include treatment, travel, or other applicable charges.

If the appointment is canceled or rescheduled more than 48 hours in advance, the deposit will remain on the patient account as a credit that may be used toward future services.

Account credits remain valid for 12 months from the original appointment date.

Botox / Dysport-Only Appointments

A $198 reservation deposit is required to secure Botox-only or Dysport-only appointments.

Botox-only or Dysport-only appointments require a minimum treatment of 25 units at the then-current per-unit rate disclosed at booking.

The reservation deposit is held as account credit and applied toward the final invoice for the appointment, which may include treatment, travel, or other applicable charges.

A minimum of 25 units will be charged for Botox-only or Dysport-only appointments.

If additional services are performed during the appointment, the reservation deposit will be applied toward the total service invoice.

Telehealth Consultation

A $149 consultation fee is required to reserve a telehealth consultation appointment.

Cancellation Policy:

BODYWRX requires at least 24 hours' notice to cancel or reschedule an appointment. Your appointment reserves dedicated provider time. Once confirmed, that time is held exclusively and cannot be offered to other patients. If I cancel or reschedule more than 48 hours before the scheduled appointment time: the reservation deposit will remain on my account as a credit for future services. No cancellation fee applies. If I cancel or reschedule between 24 and 48 hours before the scheduled appointment time: a fee equal to 50% of the reservation deposit will be retained as a late cancellation fee. The remaining balance will remain on my account as credit for future services. If I cancel or reschedule less than 24 hours before the scheduled appointment time: the full reservation deposit (100%) is non-refundable and will be retained as a late cancellation fee. All time windows above are measured from the scheduled appointment time, not from the time notice is given. If cancellation occurs after the provider has been dispatched, applicable travel fees may still apply (see Dispatch Definition below).

Dispatch Definition: 

Dispatch occurs when the provider has departed for the confirmed appointment location. Once dispatch occurs, any applicable travel fee is considered earned and non-refundable due to provider travel time.

No-Show Policy: 

Patients are expected to be ready for their appointment at the scheduled time. If the provider arrives and access to the appointment location is delayed, Bodywrx may wait up to 10 minutes. If the appointment cannot begin within that time, the appointment may be considered a late cancellation or no-show, and applicable fees may apply per the Cancellation and No-Show Policy. If the provider arrives at the confirmed appointment location and I am not present or otherwise unavailable to receive services:

  • My reservation deposit will be retained.
  • Any applicable travel fee may be charged or invoiced.
  • For Botox-only or Dysport-only appointments, the minimum treatment requirement may still apply as disclosed at booking.

Modifications to the Service and Prices:

Prices for products and services are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

Insurance:

Bodywrx does not accept insurance for services or products. All services and products are self-pay only.

Accuracy of Billing and Account Information:

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

Data Collection and Consent:

By providing personal data or engaging with Bodywrx's services, patients consent to its collection, processing, storage, and use in accordance with this Privacy Policy. Data may be collected directly through forms, applications, and other interactions, or through automated means such as cookies, IP addresses, device information, and browser type. This data is collected to enhance security, prevent fraud, and improve service delivery. The following types of information may be collected:

Personal Data: 

Name, email address, payment information.

Sensitive Health Data: 

Medical history, diagnostic reports, blood work, peptide protocols.

Identity Verification: Profile photos and driver’s licenses for patientship verification.

Optional Health Data: 

Additional health information voluntarily uploaded by patients for peptide safety assessments. Patients are solely responsible for the accuracy and completeness of any optional health data they choose to upload. Bodywrx does not verify the accuracy, completeness, or relevance of such data.

Cookies and Tracking Data:

Information collected through cookies and other tracking technologies on the website.

Data Usage:

Data collected by Bodywrx is processed solely for operational purposes, including health optimization, peptide safety assessments, patient management, regulatory compliance, fraud prevention, contractual enforcement, and dispute resolution. Additionally, data may be used for internal analytics using anonymized or aggregated data and, with explicit patient consent, for marketing communications. Data Storage & Security:

All collected data is stored on secure data systems that implement encryption, access controls, and data protection protocols to safeguard patient data. Bodywrx may utilize secure third-party processors for data management and storage, each of whom is contractually obligated to adhere to industry-standard data protection practices. Access to sensitive data is restricted to authorized personnel only. Bodywrx shall not be liable for any breaches, unauthorized access, or data misuse resulting from patient negligence in safeguarding login credentials and personal account information. Bodywrx implements reasonable security measures to protect patient data. However, Bodywrx is not liable for unauthorized access resulting from unencrypted communications, including but not limited to email, SMS, or other unsecured methods. However, Bodywrx cannot guarantee the security of data transmitted via email or SMS. Patients are advised to use secure methods for sharing sensitive health information.

Patient Rights and Data Access:

Patients have the right to:

Request a complete copy of their data at any time.

Update or correct inaccurate information.

Request deletion of personal data, excluding data required for regulatory or legal compliance. Requests for deletion may be subject to applicable legal or regulatory requirements.

Opt out of marketing communications by replying STOP to SMS messages or by contacting us at info@thebodywrx.com. Opting out of marketing communications will not affect patientship status or access to services.

Cookies and Tracking Technologies:

Bodywrx uses cookies and similar tracking technologies to monitor website traffic and assess user engagement. By using our website, patients consent to the collection of cookies. Patients can disable cookies through their browser settings.

Data Sharing, Processing, and Third-Party Processors:

Bodywrx may share data with third-party processors solely for operational purposes, including payment processing, data storage, communications delivery, website analytics, and fraud prevention. All third-party processors are contractually required to adhere to industry-standard data protection practices. All third-party processors are contractually obligated to adhere to industry-standard data protection practices. Data will not be shared for marketing purposes without explicit consent.

Data Retention and Disposal:

Data is retained for as long as necessary to fulfill the purposes for which it was collected, or as required by law or regulatory obligations. Data that is no longer required for operational or regulatory purposes will be securely deleted using industry-standard disposal methods. Patients will be notified of material changes to this Privacy Policy or data breaches via email, SMS, or a prominent notice on Bodywrx's website.

Data Breach Notification and Limitation of Liability:

In the event of a data breach involving personal or health data, Bodywrx will notify affected patients within 72 hours of becoming aware of the breach. Notification will include the nature of the breach, the data affected, and recommended steps patients should take to protect themselves.

Bodywrx is not liable for any direct, indirect, incidental, consequential, punitive, or special damages arising from data breaches, unauthorized access, data misuse, or third-party platform vulnerabilities, including those resulting from patient negligence in securing login credentials. Patients are responsible for maintaining the confidentiality of their login credentials. Bodywrx shall not be liable for unauthorized access resulting from patient negligence in securing account information.

Dispute Resolution and Arbitration:

Any disputes arising under this Privacy Policy shall be resolved through binding arbitration in California. Patients waive their right to participate in class action lawsuits or class-wide arbitration. All claims must be brought individually, and the arbitrator shall not consolidate claims or award class-wide relief. This provision applies to all claims under or related to this Privacy Policy.

This Privacy Policy Addendum for California Residents (the “California Privacy Addendum”) supplements the information contained in Bodywrx’s Privacy Policy and describes our collection and use of Personal Information. This California Privacy Addendum applies solely to all visitors, users, and others who reside in the State of California (“consumers” or “you”). We adopt this notice to comply with the California Consumer Privacy Act of 2018 (“CCPA”) and any terms defined in the CCPA have the same meaning when used in this notice.

Note that this California Privacy Addendum does not apply employment-related personal information collected from our California-based employees, job applicants, contractors, or similar individuals. Please contact your local human resources department if you are a California employee and would like additional information about how we process your Personal Information.

Where noted, this California Privacy Addendum also does not apply to personal information reflecting a written or verbal business-to-business communication (“B2B Personal Information”). 

Telehealth Disclaimer

Purpose & Scope:

The telehealth services provided by Bodywrx Inc. (“Bodywrx,” “we,” “us,” or “our”) are strictly limited to safety assessments and peptide recommendations conducted by a licensed physician in the State of California. Telehealth consultations are provided solely for health optimization purposes and do not include diagnosis, treatment, or management of general medical conditions. The physician may review additional health data voluntarily uploaded by patients, but strictly for the purpose of assessing peptide safety and making adjustments to peptide recommendations. The physician is not the patient’s primary care provider and does not establish a traditional doctor-patient relationship.

Content and Risk Acceptance:

By scheduling a telehealth consultation or selecting an asynchronous review, the patient consents to the telehealth services provided by Bodywrx. Patients acknowledge and accept all risks associated with the use of peptides based on disclosed medical history and health information. Bodywrx does not assume responsibility for adverse effects arising from undisclosed medical conditions, medication interactions, or incomplete or inaccurate health information provided by the patient. Patients are solely responsible for the accuracy and completeness of any health data they choose to upload. Bodywrx and its affiliates do not verify the accuracy of such data and shall not be liable for adverse outcomes resulting from incomplete or inaccurate disclosures. Patients are required to disclose all current medications, supplements, and relevant health conditions to ensure accurate peptide recommendations.

Telehealth services provided by Bodywrx are based solely on the information disclosed by patients. Bodywrx is not liable for adverse outcomes resulting from incomplete, inaccurate, or undisclosed health information.

State Specific Telehealth Limitations:

Telehealth services are strictly limited to residents of California. Patients must confirm their physical location in California at the start of each telehealth session or asynchronous review. If a patient is located outside of California, the session will be terminated immediately and rescheduled for a later date. Bodywrx reserves the right to terminate telehealth services if a patient fails to disclose relevant health information, misrepresents their health status, or attempts to misuse telehealth services for purposes beyond peptide safety assessments. Bodywrx does not provide telehealth services to patients temporarily residing outside of California or in states where the physician is not licensed.

Emergency and Urgent Care Disclaimer:

Bodywrx does not provide urgent care, emergency services, ongoing medical management, or primary medical care through telehealth. In the event of a suspected adverse reaction to a peptide protocol, patients are advised to discontinue use immediately and to seek emergency medical care. 

Check-Ins and Follow-Up Requests:

Bodywrx team may provide peptide recommendations based on patient feedback and general health optimization goals; however, such recommendations are not to be construed as medical advice, diagnosis, or treatment. All peptide protocols must be confirmed by the physician solely for safety and dosing purposes. These check-ins are not medical consultations but may result in a request for further analysis by the physician, strictly limited to peptide safety assessments and potential adjustments to peptide protocols. The physician does not establish a traditional doctor-patient relationship and will not provide follow-up care beyond the scope of peptide safety assessments and recommendations. If the Bodywrx team identifies a need for further analysis by the physician, a telehealth session may be requested, strictly limited to peptide safety assessments and protocol adjustments.

Payment and Insurance:

Bodywrx does not accept insurance for telehealth services. All telehealth services are self-pay only.

Data Privacy and Communication:

Telehealth consultations are recorded, and all communications are conducted through secure, encrypted channels. However, Bodywrx cannot guarantee the security of data transmitted through unencrypted methods, such as email or SMS. Patients are advised to use secure channels for sharing sensitive health information.

Limitation of Liability:

Bodywrx, its physicians, employees, and affiliates shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of telehealth services, including but not limited to adverse reactions to peptides, miscommunication of health information, or missed diagnoses. By accessing telehealth services, patients expressly waive any claims against Bodywrx arising from the use or misuse of telehealth services, including but not limited to claims related to missed diagnoses, incomplete or inaccurate health disclosures, delays in care, or miscommunication of health information.

All products offered by Bodywrx Inc. (“Bodywrx”) are intended solely for health optimization purposes and are not intended to diagnose, treat, cure, or prevent any disease or medical condition. The information provided on Bodywrx’s website, marketing materials, or consultations is for educational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment.

Assumption of Risk:

By purchasing and using any product offered by Bodywrx, patients acknowledge and agree that they are voluntarily choosing to use such products and assume all risks associated with their use, including but not limited to potential adverse effects, allergic reactions, or interactions with other medications or supplements. Patients are solely responsible for consulting with a qualified healthcare provider regarding the appropriateness of product use based on their individual health circumstances.

Bodywrx disclaims liability for adverse effects resulting from product interactions with other medications, supplements, or underlying health conditions. Patients are solely responsible for consulting with their primary licensed healthcare provider to assess potential risks associated with product use.

Voluntary Participation:

Patients acknowledge and agree that all participation in Bodywrx’s services and use of its products is voluntary and undertaken at the patient's own risk. By engaging in services or using products offered by Bodywrx, patients assume full responsibility for any and all outcomes, including but not limited to health-related effects, adverse reactions, or unintended consequences.

Bodywrx disclaims liability for any damages, injuries, or losses resulting from voluntary participation, misuse, or failure to follow product instructions.

Indemnification and Hold Harmless:

By using Bodywrx’s services or products, patients agree to indemnify, defend, and hold harmless Bodywrx Inc., its owners, officers, employees, contractors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, or expenses, including reasonable attorneys’ fees, arising from or related to:

  • Misuse, unauthorized use, or unintended application of products;
  • Failure to follow product instructions or recommended guidelines;
  • Patient's failure to disclose relevant health information;
  • Patient's breach of any terms outlined in this agreement or applicable disclaimers.

This indemnification obligation applies to all claims, whether asserted by the patient, third parties, or government agencies.

Manufacture Responsibility and Product Quality:

Bodywrx is not the manufacturer of the products offered and disclaims any liability for product defects, contamination, sterility, or manufacturing inconsistencies. All products are research-grade peptides. Certificates of Analysis (CoAs) are available upon request to info@thebodywrx.com. Bodywrx does not independently verify CoAs or product testing results. Products are for research purposes only. Not for human consumption or clinical use. The buyer is responsible for adhering to all local laws and regulations.  

Third-Party Goods and Services:

Parties other than Bodywrx Inc., including Labs, Pharmacies, Medical Groups and Providers, provide services or sell products through the Service (collectively, “Third-Parties”), and Bodywrx Inc. may also make available to you for purchase certain services, devices, items or products manufactured, distributed or sold by Third-Parties (“Third-Party Goods and Services”). Your use of any Third-Party Goods and any interactions with Third-Parties, including payment and delivery of goods or services, and any other terms, conditions, warranties or representations associated with such use or interactions, are solely between you and such Third-Parties. You should make whatever investigation you feel necessary or appropriate before proceeding with any online or offline transaction involving Third-Parties or any Third-Party Goods and Services. 

You are solely responsible for, and shall exercise caution, discretion, common sense and judgment in, using the Service and disclosing personal information.

You agree that Bodywrx Inc. shall not be responsible or liable for any loss or damage of any sort incurred as the result of your use of the Service, including any Third-Party Goods and Services or your interactions with any Third-Parties. In the event of any dispute between you and any Third-Party, any other User or any other entity or individual, you understand and agree that Bodywrx Inc. is under no obligation to become involved in such dispute, and you hereby release and indemnify Bodywrx Inc. and its directors, officers, members, managers, employees, contractors, representatives, agents, predecessors, successors, and assigns, (collectively, “Bodywrx Inc. Parties”) from any and all claims, demands and/or damages (actual or consequential) of every kind or nature, known or unknown, suspected and unsuspected, disclosed or undisclosed, arising out of or in any way related to such disputes or the Service or the features and services therein. IF YOU ARE A CALIFORNIA RESIDENT, YOU WAIVE CALIFORNIA CIVIL CODE SECTION 1542, WHICH STATES: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.”

Certain of Bodywrx Inc.’s owners, managers, officers, employees, contractors or agents (collectively, “Bodywrx Inc. Owners and Personnel”) may have a financial interest in one or more Third-Parties and may profit from your use of the Third-Parties and/or the sale of Third-Party Goods and Services to you.

Contraindications and Safety Precautions:

Products offered by Bodywrx are not recommended for use by individuals who are pregnant, nursing, under the age of 18, or with known health conditions without prior consultation with their primary licensed healthcare provider. Patients are advised to review product ingredients and potential contraindications prior to use. Bodywrx disclaims any liability for adverse effects resulting from misuse, overdose, or failure to follow recommended guidelines.

Patients waive their right to pursue any claims related to product use through class action lawsuits.
